Legislation related to Direct Selling in New Zealand
  The legislation outlined below are the most applicable areas of legislation to Direct Selling Companies, their distributors and the public. Use the link at the bottom of the page to view online copies of the actual legislation.
The DSA provides to its members member downloadable Guides & Regulations relating to these Acts from within the Members Only section.
Advice for the DSA in some areas may involve charges although generally services to members are free.
  The law covering how companies, partnerships and business must act. This law picks up some anti-trust elements such as monopoly trading and price fixing
  The law on guaranttees for end consumer products and also the rules for money back on defective products and including delivery obligations.
  Covers Direct Sellers rights to enforce copyright local and internationally
  Covers all sales made using credit and finance. Please note there are amendments that add in significant obligations for those providing finance
Dietary or health supplements are currently regulated under the Food Act by these regulations. You must comply with them if you sell these type of products in New Zealand. There are proposals to move these to a new regulatory structure so check with the DSA on if and when that may apply.
  Required reading if you employ staff and to ensure your Independent Contractors Status is correct.
This new law has some fishhooks not in the previous Employment Contracts Act -
If in doubt the DSA has a chargable service available to make sure you are on the right track.
This law covers all work whether it is being performed as an employee or as a contractor. Members may request from the DSA its guide for compliance with Direct Sellers
  Covers specifically Consumer transactions, Direct Sales legal obligations, Pyramid Schemes, what are deceptive or illegal repreprestations and unsubstantiated claims. This also includes a section that provides for "do not knock" obligations for door to door selling.
  Sets holiday minimums for for employees & Statutary holidays when working is not permitted. (including Direct Sellers)
  The rights of the individual to privacy and the legal requirements in handling the individuals information

This is where you can register trademarks if you have not internationally applied for recognition
The Enviromental Protection Authority is the place you need to go to register if you are importing or manufacturing any chemical products such as cosmetics or cleaning products including products that use natural ingredients.
